About these terms
These terms apply to your use of powerupportal.com and, where you purchase Power-Up Portal through this website, to the relevant purchase and software licence. Power-Up Portal is operated by Lloyd-Rose Digital Solutions Ltd, company number 17290088. You can contact us through our Contact page.
The service
Power-Up Portal is a WordPress-based software product designed to support structured programme delivery, including chapters, tasks, goals, milestones and progress-related functionality. The features included in a particular licence or version are those described on the website or at checkout when you purchase.
Orders and payment
Prices, currency, licence period and any applicable taxes or charges are shown on the product page or during checkout. An order is subject to acceptance and successful payment. We may refuse or cancel an order where there is a genuine pricing, availability, security, fraud or technical issue, in which case any payment taken for an unfulfilled order will be dealt with appropriately.
Accounts
You are responsible for providing accurate account and billing information and for keeping account credentials secure. You must not use another person’s account without permission or attempt to gain unauthorised access to the website, software, licensing systems or other users’ information.
Software licence
When you purchase a Power-Up Portal licence, you receive a limited, non-exclusive, non-transferable right to use the software for the licence period and scope stated at the time of purchase. The software and its underlying intellectual property are not sold to you.
You must not redistribute, resell, sublicense, publish or make the software available as a competing product, remove ownership notices, bypass licence controls, or copy or adapt the software except to the extent that applicable law expressly permits.
Your WordPress environment
You are responsible for your own hosting, WordPress environment, administrator access, backups and any third-party themes, plugins or services you choose to use unless a separate written agreement says otherwise. WordPress and third-party software change over time, so compatibility can depend on the versions and configuration in use.
Updates and changes
We may maintain, improve, secure or change Power-Up Portal over time. We do not guarantee that every feature will remain identical indefinitely, but changes will not remove rights that cannot lawfully be excluded. Where an update is reasonably required for security, compatibility or operation, you are responsible for applying it where the update is not managed automatically.
Availability
We take reasonable steps to keep the website and services available, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, third-party outages, internet failures, hosting issues, software conflicts or security work can affect availability.
Acceptable use
You must not use the website or software unlawfully, introduce malicious code, interfere with service operation, probe or bypass security controls, abuse licensing mechanisms, infringe another person’s rights, or use the service to process content or activity that you do not have the right to use.
Third-party services
Power-Up Portal operates within the wider WordPress ecosystem and may interact with WooCommerce, payment providers, hosting providers and other third-party services. Those third parties can have their own terms, privacy notices, availability and technical requirements.
Intellectual property
Unless stated otherwise, Power-Up Portal, its software, branding, website content and related materials are owned by or licensed to the operator. Nothing in these terms transfers ownership of those rights to you.
Liability and statutory rights
Nothing in these terms excludes or limits liability where the law does not allow us to do so. Nothing in these terms removes any statutory rights that apply to you as a consumer. Subject to those rights and any liability that cannot lawfully be limited, we are not responsible for losses caused by matters outside our reasonable control, your failure to maintain your own systems or backups, unauthorised changes to the software, or incompatible third-party software or services.
Suspension and termination
We may suspend access where reasonably necessary to protect the service, investigate suspected misuse, address non-payment, enforce a licence limit or comply with law. Where appropriate, we will take reasonable steps to explain the reason and restore access when the issue is resolved.
Privacy
Our handling of personal information is described in our Privacy Policy.
Changes to these terms
We may update these terms to reflect changes to the service, law, security or business operations. The latest version will be published on this page. Changes do not retrospectively remove rights that have already arisen under an existing purchase or rights that cannot lawfully be excluded.
